Yup you are right the terms and conditions of the merc packs and the language contained in addition to the cliams CCP had made regarding resets, commercial release indeed allows me to furnish a claim to something that was agreed upon when i exchanged money for it. I have not received the full terms of that agreement yet CCP by way of its third party vendors (sony, gamestop) have gotten to keep my money.

Heres the numbers to be clear the refund of 30 day active boosters up to 5 since passive wasnt included as i said no boosters bought with AURUM.

thats 95,200 x 4 x 5= 1,904,000 SP over the course of 5 months They actually still have to use the boosters play and hit cap and even then after 5 months of playing they will have accrued an extra 1,904,000 SP as a result. Game breaking i know right

The language in these packs have to be sufficient enough to stand on their own without additional need to dig for additional info. When CCP removed that language from the PSN pack they changed the terms and it then falls on them to make sure that information is disseminated in manner that ensure 100% penetrance or reasonable expecation of. (this could have easily been achieved with an in game and RL email to the game acct CCP has knowledge of them because our accounts are tied to Sony login which is tied to an email address). They failed to do any of these things and chose to either ignore the issue or have delayed so long because Legal and PR couldnt get their duck in a row and likely were afraid to create another Jita riots level incident.

This is what happens when you live in a litigation happy society where people will sue out of spite even when a company tries to be forthcoming and own up to making a mistake. Trust me i know this because American medicine is practiced entirely with that single fact in mind.

But here CCP has failed on multiple levels. Remember when Noc got that threadnaught started about 1-2 weeks ago and we got a dev response that they would look into it and get us back a response after telc or tiel originally submitted the question back on 1/14(4 days into TQ migration) We are still waiting.

Since it was listed in the terms of sale, then yes they are entitled to it. There are things in the business world called contractual obligations and contract laws. Since the item description at the time of purchase for those people was worded that way, CCP is contractually obligated to uphold its end of the purchasing agreement just like we as customers have our own obligations when it comes to the purchasing agreement.

As far as business law is concerned contracts are binding obligations regardless of if it is fair or not for either party. That is why you should ALWAYS read everything before you sign your name or click 'I accept.' Ever heard the saying "read the fine print"? If you are ever unsure of what something means in a contract, have a professional legal advisor look it over.




If CCP doesn't uphold their end of the purchasing agreement they would open themselves up for breach of contract lawsuits from anyone that had purchased those merc packs. This would be a huge waste of their money and would probably mean the end of DUST514.

OR CCP could uphold their end of the purchasing agreement and re-issue the merc packs to those that bought the ones with those specific terms of sale. Considering everything they would be doing is just computer coding it would not cost CCP that much. At worst it might cost them possible future revenue from those people simply because they won't need to rebuy aurum as soon.





Unfortunately for me the merc packs that I bought didn't have this clause anymore. Those that did buy the merc pack while it had that wording have every right to ask for what they paid for. For some people that clause was reason enough to buy multiple merc packs. Personally CCP official statement that they "wouldn't do any more SP resets" is the reason that I bought merc packs for the boosters. If they do reset SP, OR do anything that decreases the effective value of the SP that i have worked to earn (such as doubling the sp cost of skills) I will quit the game and ask for a refund of my purchases.

Honestly if you have not bought anything in DUST514, then you should have no say at all in this matter as you have not made any material investment in this product like many others have and would be considered the lowest form of stakeholder for the game.
If you are mad that some people had a chance at a great deal and took advantage of it, but you didn't.... Well too bad and I'm sorry that you feel this way. I wish I could have invested in Walmart or Apple 15 years ago too.
