Since it was listed in the terms of sale, then yes they are entitled to it. There are things in the business world called contractual obligations and contract laws. Since the item description at the time of purchase for those people was worded that way, CCP is contractually obligated to uphold its end of the purchasing agreement just like we as customers have our own obligations when it comes to the purchasing agreement.
As far as business law is concerned contracts are binding obligations regardless of if it is fair or not for either party. That is why you should ALWAYS read everything before you sign your name or click 'I accept.' Ever heard the saying "read the fine print"? If you are ever unsure of what something means in a contract, have a professional legal advisor look it over.
If CCP doesn't uphold their end of the purchasing agreement they would open themselves up for breach of contract lawsuits from anyone that had purchased those merc packs. This would be a huge waste of their money and would probably mean the end of DUST514.
OR CCP could uphold their end of the purchasing agreement and re-issue the merc packs to those that bought the ones with those specific terms of sale. Considering everything they would be doing is just computer coding it would not cost CCP that much. At worst it might cost them possible future revenue from those people simply because they won't need to rebuy aurum as soon.
Unfortunately for me the merc packs that I bought didn't have this clause anymore. Those that did buy the merc pack while it had that wording have every right to ask for what they paid for.
For some people that clause was reason enough to buy multiple merc packs. Personally CCP official statement that they "wouldn't do any more SP resets" is the reason that I bought merc packs for the boosters. If they do reset SP, OR do anything that decreases the effective value of the SP that i have worked to earn (such as doubling the sp cost of skills) I will quit the game and ask for a refund of my purchases.
Honestly if you have not bought anything in DUST514, then you should have no say at all in this matter as you have not made any material investment in this product like many others have and would be considered the lowest form of stakeholder for the game.
If you are mad that some people had a chance at a great deal and took advantage of it, but you didn't.... Well too bad and I'm sorry that you feel this way. I wish I could have invested in Walmart or Apple 15 years ago too.
Telling CCP not to uphold their contractual agreement because you don't agree with it is childish and selfish. Doing so would destroy the game and their business and have adverse affects on the PSN and its reputation in general.
Telling CCP to reset peoples SP or characters because they are asking for what they were promised is childish and selfish. Doing so would be a punishment for their paying customers and would destroy their game and business and would have adverse affects on the PSN.
Simply going back against their official "no more SP resets" statement would destroy their game and business as there would no longer be any kind of consumer confidence or trust.
