That part isn't quite true, in fact a federal judge just ruled that it's perfectly legal to flip off a cop. If that doesn't show how false the bold'ed statement is then nothing does.

The ToS is just there in case they need to cover their ass from some random law that can be vaguely interpreted into something that allows for a lawsuit to happen.

This kind of logic is what creates rebel children. criminals and all kinds of blights on society. Also thats just one judge. Ive seen judges hold people in contempt of the court just because they looked at an officer with a nasty look so yea nice try.
