This can sometimes be due to latency. The enemy might be there on his screen, but is actually somewhere else for the server. Damage and Hit Detections are done Server-side, so this might be the case.

Why not both? Make it an inbuilt feature of Scouts, but make a weakened version available as a module/equipment as well. That way everyone can cloak, but Scouts do it 2x better than anyone else.
