to be fair though in OP's defense. CCP have many notices which state the BPO is a Permanent Item, without an asterix at the side stating they could be removed. so really on all their promotional items for the bpo's like the EVE collectors edition, the daemon shottie bpo, the merc packs or the guristas bpo code tickets they are declaring the bpos as permanent items without an exemption notice which could be the way forward in a case. at least as a way to get cash back over aurum |

It says that they can remove any paid item as long as they reimburse you with an item of equal or greater value. (Which in this case is the amount of AUR you originally paid for them)
but the issue with that is that on printed media where the EULA for the item isn't available there is no indication that the item which they state as being permanent, can be removed. which could be the way forward in an arguement. what they should have, liek any other promotion, is an asterix at the side directing people to read the EULA and note that items may be removed from game even after purchase. since CCP hasn't done this on any of the printed media for BPO items i listed then they could face an issue.
when it comes to the militia module BPOs being removed then tbh i think all you'd get is AUR. same as if they wanted to remove the M.A.G tribute suits. things like the Merc pack suits though could earn a cash or at least PSN refund seeing as people were buying a product from psn store and not in DUST, the issue would probably be more directed to PSN customer service than CCPs |

yeah that message was could be quite a killer, but then again that is still possible under the EULA, even though it is pretty unfair trading practice do do something like that, its more morally wrong than comletely legally wrong and would more than liekly come down to the judgement from OFT about action taken
Magnus Amadeuss wrote:I could definately see you being able to sue them over removal of BPOs that you bought in a pack, as those packs were advertised as having that item (like the collectors edition.)
Unfortunately I don't think the same would apply for things you purchased on the marketplace. You paid for AURUM, an in-game currency. What you did with that in-game currency I think would be outside of CCP's advertised product (aurum) so I think they would be in the clear. Now if you paid like $5 directly for those BPOs, then I could see there being real problems.
yeah items bought ingame for AUR would simply be awarded AUR refund. you can't prove you bought the aurum just for that item. where that may differ is with items that was advertised under the above quotes message. CCP directed you to buy them so you didn't miss out, items bought with aurum during the period CCP suggested you buy the items so not to miss out on them could be entitled to a cash refund as players would been more likely to purchase aurum for specific purpose of buying them |
