I didn't read all the responses but there's an easy way to take care of them now, just shoot the vehicle with any type of turret and it will kill the driver almost instantly leaving you with a free vehicle to hack.

This is new since 1.2 the hit box on LAVS is broken... AV nades will kill the driver as well now leaving the vehicle still alive for a free hack and vehicle. It's like the driver absorbs all damage dealt to the vehicle first, and then the vehicle...
