So... The EULA says I am obligated to only store DUST software on a password-protected computer.... My PS3 is not a computer and I don't have a password on it. Do I need to password my PS3 before you void my account license?
Next, the EULA states this game has the highest PEGI rating of mature because it was not yet rated, but the game actually is rated at PEGI-16. Finally, why is the EULA under Welsh law, but the NDA under the jurisdiction of Georgia, USA? It's confusing. |

Hi there,
Checked with our legal department about your questions and here's some answers to your questions.
- The PEGI ratings were due to the fact that we were awaiting final rating (we are still in beta) and that is why the old EULA indicated a mature rating. The EULA was updated once we received the final rating for DUST 514, and this means the updated EULA now applies.
- With regards to the jurisdictions on EULA and NDA, keep in mind that EULA is an commercial agreement and thus falls under local jurisdiction. The NDA is a mutual agreement between two parties and not bound to a particular region and thus was located in Georgia because that is where our legal team is located.
We will have an answer for you on the question regarding the password protection requirement shortly. |

A PS3 is technically a computer in the broadest definition.
DUST can't be accessed without PSN access, which is password-protected.
I think you're safe. |

Yes, however, that clause was with regards to the fact that only one copy of "the Software" was allowed and unauthorised access to the console could result in an extra copy done by someone else. As to why the PS is referred to as a computer I would guess a copy&paste going on from EVE :p |

So it seems like you didn't really have a question, just wanted to show off that you read the EULA and try to point out mistakes? |

Until you consider that most PSN downloads are tied to the account which downloaded them, and can't be accessed except with that account registered on the PS3, so any attempted copy will be automatically rendered useless except to a person with the relevant PSN account password. |

So PSN downloads are encrypted on the drive? That's good to know then. This means as long as I don't use the save-password feature, I should be safe from violating the EULA. |

I seen that it had to be on a password protected computer as well. Also a PS3 is a computer but most people don't associate it with a Desktop or a laptop. Anyway when I read that I took it as having a password for like when you sign in to the PSN. Since that is required anyway I just unchecked the save password on my PS3.
Also I have a password for my house.... It's called a 30-30 and anyone attempting to steal anything from my house will, well i'll leave that up to peoples imagination lol. |

IMO it's just a generic wording translating to "Please don't leave the game somewhere where others might access it right away." In general this means, for PC betas, don't put it on a web server or somewhere, where people might access it without requiring any access controls. But for a console (or a gaming PC at home)... just general precautions, like not giving away your hardware or your passwords and not granting hard disk access to anyone and you should be fine.
According to most beta EULAs/NDAs you're also not allowed to show any parts of a game to third parties ever, but let's be honest, some family member or friend entering the room while you play? You don't have to lunge towards the TV to turn it off instantly. It's usually no problem at all, just tell them about the NDA and you should be fine (there's no real way for someone to check this anyway). Just don't get all your friends invited for some beta goodness. ;) |
