If you're in amarr faction warfare and you're using an amarr scout to shiv people, you're not only fighting for your employer, but representing them.
Rewarding running amarr gear rather than blocking running anything else is the better option there.
This was mentioned in the FW proposal thread several months back. The formula that was mentioned was something along the line of more ISK/LP compensation for running Factional gear. I should did that up buto thw resolution we came to was Rewarding the player for "Role Playing" and not punishing the player if he/she doesn't want to.

I mean at what point is someone using 'predominantly' factional content penalised and not granted their bonus LP?

Are you wondering it in the hypothetical sense in a world where we have what were talking about it FE or are you talking about currently?
