Point me to the section of the rules that states it's against the ToS? The only section references rapid keystrokes:

You may not use your own or any third-party software, macros or other stored rapid keystrokes or other patterns of play that facilitate acquisition of items, currency, objects, character attributes, rank or status at an accelerated rate when compared with ordinary Game play. You may not rewrite or modify the user interface or otherwise manipulate data in any way to acquire items, currency, objects, character attributes or beneficial actions not actually acquired or achieved in the Game.

None of that is impacted by the turbo function. Moreover, you can't ban that function on the PS3 because they're perfectly valid controllers.

He has equipment that let's him perform better. Deal with it. There's no difference to someone playing with a 100 quid mouse or keyboard.

There is a clear difference to an intended feature and something unintended. Don't compare comms to modded controllers, one is fair play and the other is underhanded tactics.
