1) Well, anyone who is in a stream of bullets should be plenty visible. And this actually follows into...
2) you are wrong. Cloaking, in EVE, is deactivated if anyone comes within a certain radius of you (2km I believe) - scaled down to DUST this'd probably be about 20m. More reasonably, deactivation upon the reception of damage makes plenty of sense: stealth is gone when bullets are flying, you should either fight or disengage to recloak.

Essentially, you can use a cloak to get close, but it should not substitute for actual, proper stealth ability: it should be a tool to enhance stealth prowess, not replace it. Being revealed within 20m does not mean that you are noticed: you should have positioned yourself such that people do not walk right through your position.
