Since progress carries over to Legion, this won't ever happen. A respec should be 100% reasonable though, considering any transfer to Legion would have to logically un-allocate your SP anyways. Your DUST 514 account is linked to the Tranquility server, which belongs to CCP.

Easy, you don't.
The Character Data belongs to CCP, and is already on CCP's servers. Not only is CCP not contractually obliged to hold DUST as a PS3 exclusive, EVE: Legion is technically a different game, so it wouldn't matter either way.
