The fallacy applies, but have you noticed how everyone whose supposedly falling for it spots a cloak when they are not being shot at? Or when they have some breathing room? Or when, for whatever reason, they have the time and gumption to look for cloaks?
The point of the cloak is to sneak around and cause havoc when the enemy is not paying attention, whether because they are suffering from Blueberry Syndrome or are engaged in a firefight. The shimmer is easily noticed when you are not busy doing other things. I've killed many scouts with my tank who thought I couldn't see them moving in to place RE on me. I'm sure there aresome I missed while driving around, but I wasn't looking for them then.
You can still see a still cloaked scout by the way the light distorts around the cloak. Judge's video is a very poor portrayal of the situation. This is no fault on Judge's part, and i rather like his videos on Dust, but on the part of the visual quality of his video. The cloaks are near invisible to see on the videos because the quality is far lower than the actual game play. Even on his video, I saw the cloak working as intended. Yes when you pause frame by frame you can see the scout, even with the low video quality. But in all the chaos of that battle, he would have slipped by unnoticed.
I will grant that sometimes a cloak makes them stop rendering, I personally having observed a cloaked scout disappear from my screen and then reappear a second later as I got closer. Perhaps this is the cause of a lot of complaints, and should be fixed ASAP.
