This is definitely looking fishy.
There are two kinds of scams. One kind is permitted by CCP and the other is condemned by CCP. The one condemned is that which involved game codes and other transactions that involve out-of-game currency. If you scammed a player earlier in regards to the code, then you deserve to get your ISK confiscated and now you're covering it up with a fake excuse that the transaction occurred before the rules went into effect.
The other kind of scam is the kind that is only within the game itself. These are the kind allowed by CCP according to New Eden standards. Contract scams, window-trade scams, "doubling ISK" scams, and such fall within this category. Since these have not been established yet, except the doubling ISK part, we can rule out the possibility that this was involved.

Actually, this thread makes sense. The last time he whined about unfair treatment just for scamming someone he got free Templar-gear. That thread was more fun though ;). I already lost isk for scamming, no need to take more, it was just overkill
Unless of course there was another "out of game" scam involved that you didn't tell us about.
