Hmmm... well its nky defraudment if he spent money on said game, and as said games options to spend money, is optional, a case of defraudment would be hard to prove. At least against other players.
Against CCP he may have a chance, as they are legally bound to take action against people who violate the eula

I can only hope, I would totally join a class action suit against those asshats, unfortunately don't think its viable
