Coming from halo reach, I know what it is like to deal with kick happy retards. One accidental team kill, and you're gone half a second later. They won't even read the button, or think about what their decision will cause. They will just press the button and continue playing without think about they have done. Allowing the forgiveness button to be pressed first before the punishment button could help fix that problem. If they really wanted to punish you, they could wait 5 seconds to do so, or they could immediately press the forgiveness button and keep playing.
People even kicked their own friends before they had the chance to say sorry

That's the problem, they will instantly press the punishment button without actually considering what it will do. Locking the punishment button for 5 seconds can help stop that from happening. Give the idiot a moment to think before he does something stupid, and maybe even give the team killer a chance to say sorry.

Hence them having to 'do something' in order to punish you. they still won't think about it.

As Nullarbor stated explicitly earlier in the thread, the default is forgiveness and punishment requires a conscious effort. Exactly what you want. As for the fact of unintentional sloppy aiming getting people kicked from the match because most players choose to punish anyway, I believe we are all familiar with the phrase: GET GOOD you can control accidents.
