If the attack wins the first battle and looses the automatic re-up they are not given a 1 hour window to reinitialize their attack and because of this the defender is given the 48 hour window as well as 1 day of clone regeneration. |

The second part, (only being able to re-attack if you have won), is coming with the rest of the changes detailed in this dev blog.
If you lose the reup battle then that counts as a defence so the attacker has to wait out the hour from the start of that battle before they can attack again. The attack would then happen 2 days later instead of 1 day. |

I looked at the dev blog and it didn't really cover what happens when the attacker looses the 5 minute re-up, it only states that the defender if they loose the first battle should not get any clone regen at all.
Taken from the dev blog on attacking:
This means battles will have the following possible outcomes:
The defender wins. Any new attack will follow the normal rules of attack and require a minimum of 24 hours notice before happening. The attacker wins and the defender has 0 clones remaining. The attacker takes control of the district. The attacker wins, still has 100 or more clones, and the defender still has clones. Another battle will begin in 5 minutes, The attacker wins, has less than 100 clones, and the defender still has clones. Attackers clones go home and the attacker has an exclusivity period of 1 hour from the time the final battle began to launch a follow up attack.
There is, however, a lingering question. Does the district still generate clones on the next reinforcement cycle if the defenders lose a battle and then win the second battle? The answer is no. If a battle is lost the district will not generate clones on the next reinforcement cycle. |

Also I find it strange that loosing the re-up causes a loss of exclusivity on the attack, basically the rules for that sedond battle seems very confusing at the moment.
The defender will get one RT worth of clones because they won the second battle (which means you will have to wait 47 hours before the next battle itself begins). It's only fair since they won a battle, too. |

There are 2 possible scenarios here, so to clarify:
1 Battle, Attack and Lose The attacker cannot reattack until roughly ~47 hours later and the defender will get 2 reinforcement cycles in that time.
2 Battles, Attack and Win, Reattack and Lose The attacker cannot reattack until roughly ~47 hours later, but the defender will already have a stalled clone production for the first cycle. So only one new batch of clones will be produced in that time. |
