That would largely depend on Sony's PSN policy since Sony is the one managing your account information. However, that does not mean CCP will not be able to punish you for certain things. They do have control over your character such as confiscating ISK and assets if those were gained illegally or through exploits, changing the name of the character if it has an inappropriate name or is known to impersonate another player or dev, and can ban your account from having access to the forums. I'm not sure about access the game on the PS3, though.
But in Eve Online, since CCP has more direct access to the accounts there, Eve players face harsher punishments including a permaban from the game itself.
But CCP's policy for Eve Online is often carried over to Dust which might include their rules regarding sharing account information which is seen by CCP as a punishable offense.

So ya probably would get banned or face some sort of punishment....thank you, guess I'll just let my toon die, seems like such a waste but oh well.
If by "let my toon die" you mean biomass it, don't do it. Just enable passive training on that character on let it sit in your account. CCP doesn't delete any inactive accounts from their database.
